Terms and Conditions and Waste Removal Service Agreement

Coastal Sanitation of NC, LLC — Effective date: March 23, 2026

1. Agreement Overview

These Terms and Conditions, together with the Waste Removal Service Agreement below, govern your use of Coastal Sanitation of NC, LLC’s website and the waste removal services we provide. By paying an invoice, setting your bin out for collection, signing up for service, or otherwise using our services, you ("Customer") agree to this Agreement.

2. Waste Removal Service Agreement

By paying the invoice and setting your bin out for collection, you ("Customer") agree to the following terms and conditions ("Agreement") with Coastal Sanitation of NC, LLC ("Coastal").

2.1 Fees & Billing

  • Setup Fee: A one-time fee of $30 is required for account activation and bin delivery.
  • Billing Cycle: Billing is quarterly. Invoices are sent 30 days before the due date.
  • Refunds: No refunds will be provided.
  • Payment Method: A valid card must be on file when services begin.
  • Payment Deadline: If payment is not received by the 1st day of the billing cycle, the card on file will be charged, and service will not commence until the payment is processed.
  • Late Fee: A late fee of $15 will be applied if payment is not received 15 days after the due date.
  • Missed Pickups: Pickups missed due to late payment will not be refunded.
  • Non-Payment: An $80 fee will be added after 30 days of non-payment. At that time, the bin will be repossessed and any outstanding invoices may be sent to a collection agency.
  • Bin Replacement: An $80 fee will be added if the Coastal bin is lost or damaged beyond reasonable wear and tear.
  • Bin Delivery Payment: Payment for bin deliveries is due by 5 p.m. the day before your bin is scheduled to be delivered.

2.2 Cancellation Policy

  • Notice Required: Customers must provide 30 days’ notice before canceling services.
  • Cancellation Fee: A fee of $70 applies ($30 for bin cleaning and $40 for bin pickup).
  • Additional Cancellations: For accounts with additional bins, an extra $30 cleaning fee will apply per additional bin.
  • Bin Handling: Due to insurance restrictions, customers may not pick up or drop off bins at Coastal’s yard.
  • Post-Cancellation Requirements: Upon cancellation or termination, all bins must be emptied and set to the curb on the collection day determined by Coastal. Failure to comply, thereby preventing bin retrieval, will incur additional fees for rescheduling and emptying the bin.

2.3 Acceptable Waste & Disposal Guidelines

  • Accepted Materials: Only municipal solid waste is accepted.
  • Prohibited Materials: Unacceptable items include, but are not limited to:
    • Hazardous waste (including, but not limited to, oil, gas and/or gas cans, batteries, fluorescent light bulbs)
    • Metal
    • Construction debris
    • Other prohibited items such as furniture, appliances, televisions, and small appliances
  • Bin Requirements: Bins must remain closed. Bulk pickup rates will apply for any items placed outside the bin.

2.4 Courtesy Policy

  • Household Bags: Up to two household bags placed outside the bin are accepted at no additional cost.
  • Restrictions: Extra-large bags are not included.
  • Excess Bags: If more than two household bags are set out without prior notice, additional bags will not be collected.

2.5 Bagging Requirement

All trash must be bagged prior to disposal.

2.6 Coastal Representations

Coastal represents and warrants that the waste removal services will be performed in a workmanlike manner and in compliance with all applicable laws, regulations, codes, restrictive covenants, and homeowners’ association requirements. Coastal further warrants that it is adequately insured to cover injuries to its employees as well as any losses or injuries arising from the negligent acts of Coastal, its employees, or subcontractors. Except as expressly provided herein, no other representations or warranties, either express or implied, are made by Coastal.

2.7 Customer Representations

The Customer represents and warrants that they are the legal owner of the property—or have the authority to authorize waste removal services at the service address. The Customer further agrees to be solely responsible for any damages resulting from a breach of the obligations set forth in Section 8.

2.8 Customer Responsibilities & Obligations

  • Compliance: The Customer shall advise Coastal of all applicable homeowners’ association requirements that may impact service performance.
  • Access: The Customer will grant Coastal, its employees, agents, and subcontractors reasonable access to the service address for the performance of waste removal services.
  • Safety: The service address must be kept free of hazards or obstacles that may endanger Coastal personnel.
  • Area Clearance: The Customer shall ensure that pets, guests, invitees, family members, and agents remain clear of the area where waste removal services are performed.
  • Bin Placement: Bins must be placed out to the curb by 10 p.m. the night before your scheduled pick-up.

3. Messaging, Communications, and SMS Terms

We communicate with customers by email, phone, and SMS for account management, billing, and service notifications. The SMS Terms & Conditions are incorporated by reference and available on our website.

5. Liability and Limitation

To the fullest extent permitted by law, Coastal Sanitation of NC, LLC’s liability for any claim arising out of or relating to this Agreement or the services provided shall be limited to direct damages not to exceed the total fees paid by the Customer to Coastal in the 12 months preceding the claim. Coastal shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, even if advised of the possibility of such damages.

6. Indemnification

The Customer agrees to indemnify, defend, and hold harmless Coastal and its officers, directors, employees, and agents from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to the Customer’s breach of this Agreement, misuse of services, or violation of applicable laws or third‑party rights.

7. Applicable Law

This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles.

8. Termination

Coastal may suspend or terminate service for nonpayment, material breach of these terms, unsafe conditions, or other reasons permitted by law. Outstanding balances remain due upon termination. Customers may cancel service with at least 30 days’ written notice via email to info@coastalsanitationnc.com.

9. Miscellaneous

  • Severability: If any provision of this Agreement is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • Entire Agreement: This Agreement, together with any referenced policies (Privacy Policy, SMS Terms & Conditions), constitutes the entire agreement between the parties regarding the subject matter herein.
  • Amendments: Coastal may update these Terms and the Service Agreement from time to time. Material changes will be posted on this page with an updated effective date and, where feasible, notified to customers by email.

10. Acknowledgment

By paying the invoice and setting your bin out for collection, you acknowledge that you have read, understood, and agree to the terms set forth in this Waste Removal Service Agreement and these Terms and Conditions.
